Who Are ARC Europe?

ARC Europe is a debt collection agency based in Walton on Thames. They specialise in debt recovery within the finance, health, fitness and insurance sectors - although their remit is not limited to these areas.

ARC Europe Group is a private limited company that started operating in 2001. They're regulated and authorised by the FCA (Financial Conduct Authority) to conduct regulated consumer debt recovery and debt purchase activities.

Types of Debt That ARC Europe Can Recover

Whilst the ARC Europe Group recover a variety of different debts, they specialise in debt recovery within the following industries:

  • Finance
  • Health
  • Fitness
  • Insurance

Some of the companies their debt collection agents work for include David Lloyd, Quickquid, LA Fitness, and LV Insurance. ARC Europe also buys debt from other companies, so you may find that your creditors have sold your debt to them.

ARC Europe: Powers and Restrictions

People often confuse debt collectors with bailiffs, but they're very different entities. Whilst bailiffs are court appointed enforcement agencies with greater powers, debt collectors are quite limited in what they can do.

ARC Europe, as a debt collection agency, has the same amount of power as your original creditors, so being contacted by them shouldn’t cause any additional worry.

Can ARC Europe Enter Your Home?

Debt collectors such as those working for the ARC Europe Group can enter your home, but only if you allow them to. If you do allow entry, they cannot use force and must enter in a peaceful manner, working with you to try and recover your debt.

An agent from ARC Europe will usually contact you about your debt in writing first, so most of the time you’ll receive some notice before they visit your property. If they do visit and you want them to leave, they have to comply with your request.

Debt collection companies are not allowed to act in a threatening or provocative manner, and they're not allowed to lie to you in order to try and gain access to your home or get you to pay your debt off.

If you feel threatened by an agent, you should make a complaint to the customer service team at the ARC Europe Group. If you don't hear anything back from them, a report can be made to the FCA and the financial ombudsman.

If you need general debt advice, it might be worth speaking to the Citizens Advice Bureau first.

What Happens If a Member of the ARC Europe Group Visits My Home?

If a member of the ARC Europe Group visits your home, they may try and enter your property, but, as previously established, you don't have to let them in. They'll usually contact you in advance of the visit - although they don't have to do this, unlike bailiffs. If you want them to leave, they have to comply with this request.

As previously mentioned, debt collectors have no legal power to collect debt from you or take action, and they cannot take your goods. This means that if you don't want to deal with them if they arrive at your property, you don't have to. If you've already advised ARC Europe that you want to deal with them via mail or phone, then they're not allowed to turn up to your property.

Another important point to make is that debt collectors are not allowed to speak to anyone else about your debt, so if they try to claim from your friends and family, you should make a complaint. They also cannot turn up at your workplace and must only conduct home visits.

Can ARC Europe Take Goods as Payment?

Unlike bailiffs, debt collectors like ARC Europe cannot take goods as payment - they're only allowed to take payment towards your debt in the form of a monetary payment. They'll usually send information of your debt in writing first, so the likelihood is that you won't need to wait for ARC Europe to attend your property in person if you wish to pay them.

However, you can also choose to pay them when their debt collectors arrive on site. If you do decide to pay them, make sure you check their ID beforehand and get a receipt once paid. If a debt collector does try to take goods as payment towards your debts, then they are acting illegally. You should report them and seek legal advice immediately.

Can I Write Off My Debt with ARC Europe?

You may be able to write off your debt with ARC Europe if you choose to - however, there may be additional interest and other charges added on. As such, choosing to write off your debt could end up being more expensive than simply paying the debt itself off. If your debt has been sold to ARC Europe by your creditors, interest and other fees should be frozen

If you're looking for a debt relief solution, then look no further than NDH Financial. As a personal insolvency specialist, with an inhouse licensed insolvency practitioner, we focus on one particular form of debt management solution - IVAs (Individual Voluntary Arrangements).

Using an IVA to Clear Your Debt

An IVA is a formal and legally binding agreement between yourself and your creditors - instead of paying off all your debts individually, they're combined into one monthly payment, making the process of becoming debt-free more seamless as a whole.

IVAs are usually recommended for people with several debts that amount to over £6,000 - however, we understand that every situation will be different and can help you find the right solution to suit your case.

If you’d like to find out more about IVAs to help keep the debt collectors at bay, then NDH Financial are here to help! There's also a wide range of other debt solutions available if you don't feel that an IVA is right for you.
